Electronic waiver software that replaces the clipboard

Everything a paper waiver does, plus proof, speed and search. Customers sign an electronic waiver on their own phone, a tablet at your door or a QR code at the counter.

Quick answer

An electronic waiver is a liability or consent form that customers read and sign on a screen instead of paper. A complete electronic waiver system captures the signature, the exact text agreed to, a timestamp, the signer IP address and a tamper-evident document hash, then makes every record searchable by name at check-in. It is legally recognized under the ESIGN Act, UETA and similar laws worldwide.

What is an electronic waiver?

An electronic waiver, sometimes called an e waiver or digital waiver, is the signed agreement your business already uses, moved from a clipboard to a browser. The customer opens a link, reads the waiver text, fills in their details, answers your yes or no questions and draws a signature with a finger or mouse. The system saves the whole package as one record.

The word electronic matters more than it sounds. A PDF you email to customers and ask them to print, sign and photograph is not really an electronic waiver. It is paper with extra steps. A true electronic waiver form is a live document: required fields refuse to submit empty, a date of birth triggers the guardian flow for minors, a risky health answer gets flagged for staff, and the finished record lands in a database you can search two seconds later.

That difference shows up exactly when a waiver matters most. If an incident happens and a claim arrives eighteen months later, the question is not whether someone signed something. It is whether you can produce the exact text they agreed to, prove when they agreed to it, and show the record has not been edited since. Paper struggles with all three. A good electronic waiver system answers all three by design.

Under the hood

What a complete electronic waiver captures

Six things get stored with every signature. Together they are what makes the record defensible.

  • The signer's identity. Name and contact fields, typed by the signer, plus an optional photo if you enable it.
  • The deliberate act of signing. A drawn signature on a canvas, not a pre-ticked box. Courts look for clear intent.
  • The exact text agreed to. The waiver wording is stored with the record, so later edits to your template never change what was signed.
  • The moment it happened. A server timestamp, independent of the signer's device clock.
  • Where it came from. The signer's IP address and browser details, useful if a signature is ever disputed.
  • A document fingerprint. A SHA-256 hash of the signed content. If anything in the record changes later, the hash no longer matches and the tampering is visible.

Why an electronic waiver holds up

In the United States, the ESIGN Act of 2000 and the Uniform Electronic Transactions Act give an electronic signature the same legal effect as ink, as long as a few conditions are met. The signer must intend to sign, must consent to doing business electronically, the signature must be clearly attached to the document it covers, and the record must be stored in a form that can be reproduced accurately later. The EU's eIDAS regulation, the UK's Electronic Communications Act and the UAE's electronic transactions law follow the same logic.

Notice what the laws care about: intent, association and integrity. They say nothing about fonts or hardware. This is why a drawn signature on a phone, attached to the exact waiver text with a timestamp and a hash, is strong evidence, while a scanned signature pasted into a document is weak. One shows a deliberate act bound to a specific text at a specific time. The other shows an image that could have come from anywhere.

None of this makes a badly written waiver enforceable. If the release language is buried, overbroad or illegal in your state, moving it from paper to screen changes nothing. The honest way to think about it: your attorney is responsible for the words, and your electronic waiver system is responsible for proving who agreed to those words and when. The two jobs are separate, and you need both done well.

Getting started

Switch to electronic waivers in an afternoon

1

Bring your waiver text over

Upload your current document with the PDF import, or pick one of 30+ industry templates and paste in your own clauses. Your lawyer-approved wording stays word for word.

2

Add your questions

Name, email and signature are built in. Add health questions as required yes or no fields and mark the risky ones to be flagged.

3

Choose how people sign

Send the link with bookings, print the QR code for your counter, or stand a tablet at the door in kiosk mode. All three feed the same records.

4

Run your first real day

Staff keep check-in search open and look up each arrival by name. Valid shows green, expired and flagged records announce themselves before anyone walks in.

What switching actually changed: an example scenario

A climbing gym running weekend intro sessions had two staff members doing nothing but handing out clipboards for the first forty minutes of every session. Illegible emails meant their mailing list barely grew, and when an old member disputed a charge, finding the original signed sheet took a full afternoon.

After moving to an electronic waiver, the signing link went out with every booking confirmation. Around 80 percent of climbers now arrive already signed, the rest use the tablet at the desk. The two clipboard staff went back to coaching, every email is typed and valid, and the next record request took eleven seconds. The gym's monthly software cost is less than it was spending on paper and toner.

Choosing an electronic waiver system: the checklist

1

The exact signed text is stored per record, not just a link to your current template.

2

Required fields and guardian signing for minors are enforced, not optional.

3

Records are searchable by name at the speed of your front desk queue.

4

Flagged health answers are visible at check-in without opening each record.

5

Kiosk mode and QR signing are included, not priced as add-ons.

6

Pricing is a flat monthly number you can predict, with limits printed openly.

7

Your data exports as CSV so you are never locked in.

8

The audit trail includes timestamp, IP and a document hash, not a signature image alone.

WaiverForm checks all eight, from 5 dollars per month. If you want to see it as a signer first, the online signing page walks through that side, and the waiver app page covers tablets and phones in detail.

By industry

How different businesses use an electronic waiver form

The core is the same everywhere. What changes is which questions matter and who signs.

BusinessWhat the electronic waiver form coversThe detail that matters most
Gyms and fitness studiosAssumption of risk, PAR-Q health screen, membership rulesExpiry every 12 months so long-term members re-sign
Tattoo and piercingInformed consent, allergies, medication, aftercarePhoto ID capture and an age check before signing
Trampoline and adventure parksActivity risks, rules of play, guardian consentOne parent covering several children quickly at the entrance
Tours and excursionsTravel and activity risks, medical conditions, emergency contactSigned the night before through the booking message
Equipment rentalsDamage responsibility, safe use, return termsLinking the record to the specific rental and date
Spas and salonsTreatment consent, patch tests, contraindicationsFlagged answers visible before the appointment starts
Events and racesParticipation release, photo consent, medical infoHundreds of signers in a short window, QR at registration

Ready-made versions of each of these are in the waiver templates library, so you start from industry-specific wording instead of a blank page.

Honest answers

Common objections to a digital waiver system

"Our older customers will not manage it."

In practice, the tablet at the desk handles them. Staff hand it over the same way they handed over a clipboard. The screen uses large fields and a big signature box, and nobody has to install or log in to anything.

"What if the internet goes down?"

Keep a short stack of paper waivers as a fallback, the same way you keep a backup card reader. Outages are rare, and a phone hotspot covers most of them. Scan any paper signed during an outage into the customer record afterwards.

"Paper feels more official."

It feels that way, but paper is weaker evidence. A paper sheet cannot prove when it was signed or that the text was not changed. An electronic waiver record can prove both, which is what matters if a claim reaches court.

"We already have a waiver lawyers approved."

Good. Keep every word. Switching to an electronic waiver changes how it is signed and stored, not what it says. Import the approved text unchanged and ask your attorney to review the signing flow once.

Data and security

Where electronic waiver records live, and for how long

Signed records are personal data, often including health answers, so storage deserves a real plan. Each record should be readable only by the business that collected it, transmitted over HTTPS, and protected by the document hash so any edit is detectable. Payment details should never touch the waiver system at all. On WaiverForm, card data stays with Stripe.

Retention is the part most businesses get wrong. A waiver is only useful if it still exists when a claim arrives, and injury claims often come one to three years after the incident. For minors, many jurisdictions pause the limitation period until the child turns 18, which can stretch the useful life of a record past a decade. The safe default is simple: keep electronic waivers for the longest limitation period that could apply, and never purge records just to tidy up.

Exports matter too. You should be able to download every record as CSV at any time, so your evidence never depends on a single vendor staying in business. If a provider cannot give you that, treat it as a warning sign.

Five mistakes businesses make when they go digital

  1. Rewriting the waiver while switching. Change one thing at a time. Move your approved wording first, edit it later with legal review.
  2. Using a checkbox instead of a signature. A tick box is easy to dispute. A drawn signature shows a deliberate act.
  3. Letting minors sign for themselves. A minor's signature is generally voidable. Make the guardian flow mandatory for anyone under 18.
  4. Never setting an expiry. A member who signed three years ago signed an older version of your rules. Annual re-signing keeps records current.
  5. Ignoring the flags. A flagged heart condition answer is only useful if staff look at it. Make checking the badge part of the check-in routine.

Tool choice

Electronic waiver software vs general e-signature tools

DocuSign, Adobe Acrobat Sign and form builders like Jotform or Google Forms all collect signatures. They are not built for a front desk.

If you send ten contracts a month to named clients, a general e-signature tool is the right choice. If dozens or hundreds of walk-in customers need to sign a waiver every week, those tools fight you at every step: per-envelope pricing, email-only signing and no way for staff to look someone up at the door. Purpose-built electronic waiver software exists precisely because the front desk is a different problem.

The math

What paper waivers really cost per year

Take a studio with 400 new waivers a month. Printing two pages each costs roughly 40 dollars a month in paper and toner. Staff spend about three minutes per paper waiver handing it out, checking it and filing it, which is 20 hours a month. At 15 dollars an hour, that is 300 dollars of labour before anyone searches for an old record.

Add a filing cabinet, the occasional lost sheet and the time to retype illegible emails, and paper easily passes 4,000 dollars a year for a business this size. The same volume on an electronic waiver plan costs 144 dollars a year on Pro. The real saving is not the paper. It is the staff hours you get back at the busiest moment of the day.
